Terms & Conditions — The Rules That Protect Everyone

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Brand," or "Creator") and Socialpur ("Platform," "we," "us," or "our") governing your use of the Socialpur influencer marketing platform accessible at www.socialpur.in and all associated applications and services.

By accessing or using Socialpur in any way — including browsing the website, creating an account, posting a campaign, applying as a creator, or making any transaction — you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to any part of these Terms, you must immediately discontinue your use of the platform.

• Users must be at least 18 years of age to create an account or use any Socialpur services.
• Brands registering on the platform must be legally registered business entities under applicable Indian law (sole proprietorship, partnership, LLP, private limited, or public limited company).
• Creators must be individuals or legally registered entities with genuine social media presence across at least one of the supported platforms.
• Users must provide accurate, truthful, and complete information during registration and keep their account information updated at all times.
• Socialpur reserves the right to refuse registration or terminate accounts that do not meet eligibility requirements or provide false information.

You are solely responsible for maintaining the confidentiality of your account credentials, including your login email and password. You agree to notify Socialpur immediately at support@socialpur.in if you suspect any unauthorised access to your account.

• You may not share, transfer, or sell your account to any third party.
• All activities that occur under your account are your responsibility, whether or not authorised by you.
• Socialpur is not liable for any loss resulting from your failure to maintain account security.
• You must log out of your account at the end of each session, particularly when using shared devices.

Socialpur provides an online marketplace that connects brands with verified content creators for influencer marketing campaigns. Our services include:

• AI-powered creator discovery and matching based on 40+ data points
• Campaign brief builder and collaboration management tools
• Secure escrow payment processing via Razorpay
• Real-time campaign analytics and performance tracking
• Creator verification and audience authenticity services
• Dispute resolution and mediation support

Socialpur acts as a platform intermediary and is not a party to the contractual agreement between brands and creators. The platform does not guarantee any specific campaign outcomes, engagement metrics, or business results.

Creators retain full ownership of all original content they produce as campaign deliverables. By completing a campaign and receiving payment, creators grant the brand a non-exclusive, royalty-free licence to use, share, and repurpose the delivered content for the duration and purposes agreed upon in the campaign brief.

• Content licences are limited to the scope, duration, and platforms explicitly agreed upon in the campaign brief.
• Brands must not modify, resell, or sub-licence creator content beyond what is agreed in writing.
• Creators must ensure all content submitted is original and does not infringe third-party intellectual property rights.
• Socialpur is granted a limited, non-exclusive licence to display campaign examples for platform promotional purposes, subject to creator consent.

All payments on Socialpur are processed through our secure escrow system powered by Razorpay. Campaign amounts are held in escrow until the brand confirms satisfactory delivery of all agreed deliverables.

• Payment is released to the creator's Socialpur wallet within 24 hours of brand approval.
• Platform subscription fees are charged monthly or annually as per the selected plan.
• Applicable GST is charged on all platform fees as per Indian tax regulations.
• Creators can withdraw their wallet balance to UPI or bank account at any time with no minimum threshold.
• In the event of a dispute, funds remain in escrow until resolution by the Socialpur team.
• Socialpur reserves the right to modify platform fee structures with 30 days notice to users.

The following conduct is strictly prohibited on Socialpur and may result in immediate account suspension or permanent ban:

• Fake engagement or inflated metrics: Purchasing followers, likes, comments, views, or any form of artificial engagement.
• Misrepresentation: Providing false audience data, engagement rate, or demographic information to brands or the platform.
• Off-platform solicitation: Attempting to conduct transactions outside of Socialpur to avoid platform fees.
• Fraudulent activity: Creating fake accounts, impersonating other users, or submitting fabricated campaign deliverables.
• Prohibited content: Promoting alcohol, tobacco, gambling, adult content, counterfeit products, or any content violating Indian law or ASCI guidelines.
• Harassment: Any form of harassment, discrimination, or abusive behaviour towards other users.
• Data scraping: Unauthorised scraping, crawling, or automated extraction of platform data.

Socialpur maintains a strict verification process for all creator profiles. By applying for verification, creators consent to:

• Social account authentication and audience authenticity audit
• Engagement rate analysis and content quality review
• Identity verification as required by the platform
• Ongoing monitoring to maintain verified status

Verified status may be revoked at any time if authenticity standards are no longer met. Brands acknowledge that while Socialpur takes all reasonable measures, the platform cannot guarantee the accuracy of third-party analytics data.

In the event of a dispute between a brand and creator, the following process applies:

• Raise a dispute through your account dashboard within 7 days of the disputed transaction or delivery.
• Socialpur's resolution team reviews all disputes within 3–5 business days.
• Both parties will be given opportunity to present evidence. Funds remain in escrow during review.
• Socialpur's decision in disputes is final and binding on both parties.
• For disputes that cannot be resolved on-platform, parties agree to arbitration under the Arbitration and Conciliation Act, 1996 in Mumbai, India.

To the maximum extent permitted by applicable law, Socialpur's total liability to any user for any claims arising out of or related to these Terms or use of the platform shall not exceed the total platform fees paid by that user in the three months preceding the claim.

Socialpur is not liable for: indirect, incidental, special, or consequential damages; loss of revenue or profits; failure to achieve expected campaign results; content delivered by creators; or any third-party actions or services. The platform is provided "as is" without warranty of any kind.

Socialpur reserves the right to suspend or permanently terminate any account at any time, with or without notice, for violation of these Terms or for any conduct deemed harmful to the platform, its users, or the creator community.

• Users may delete their accounts at any time through account settings.
• Upon termination, active campaigns must be completed or funds returned to brands from escrow.
• Creator wallet balances will be paid out upon account closure, subject to identity verification.
• Provisions relating to content ownership, payment obligations, and dispute resolution survive termination.

These Terms are governed by and construed in accordance with the laws of India, specifically the Information Technology Act 2000, the Consumer Protection Act 2019, and applicable ASCI advertising guidelines. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

Socialpur reserves the right to modify these Terms at any time. Material changes will be communicated to registered users via email or prominent platform notification at least 14 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
